Terms & Conditions

We will send you a written quotation (“Quotation”) through courier/email/fax on which you have 15 days to accept from the date of the Quotation. Whilst every effort is made to keep within the original Quotation, we reserve the right to amend the Quotation at any time during the 15 days period if the Goods unexpectedly becomes unavailable or the cost of the Goods materially increases.

Your acceptance of the Quotation constitutes an Order by you. We will write to you (which may be electronically) to confirm the order (“Confirmation Order”) and provide you with an invoice for a deposit of 50% of the Quotation (“Deposit Invoice”) at which point there is a binding Contract (“the Contract”) between you and us but subject to the payment by you of the Deposit Invoice in accordance with below mentioned payment conditions, and you signing and returning a copy of our Terms & Conditions.

The Deposit Invoice is payable by you by swift, electronic bank transfer or cheque drawn or card payment and the balance, that is, the remaining 50% of the Quotation, also by way of the same method is payable by you prior to the dispatch of the tent from our factory in India. We reserve the right to cancel the Order should a payment not be met on first presentation or if prenotification of a swift transfer is not honoured by your bank. All delayed payments are subject to interest at two per cent (2%) per month from the date payment due to the date of actual payment.

The Deposit is strictly non-refundable. We will consider any request for postponement of the shipment date or dispatch date subject to our other commitments but no guarantee can be offered that postponement is possible. In any event, any postponement will be subject to a surcharge of the Quotation which shall be payable immediately.

The Goods will be your responsibility from the time of delivery. Ownership of the Goods will only pass to you when we receive full payment of all sums due in respect of the Goods including any delivery charges.

Any dates quoted for delivery of the Order are approximate only and the time of delivery is not of the essence. We shall not be liable for any delay in delivery of the Order that is caused by a Force Majeure Event or your failure to provide us with adequate delivery instructions or any other instructions that are relevant to the supply of the Order. If you fail to accept or take delivery of the Order within 14 days of us notifying you that the Goods are ready, then except where such failure or delay is caused by a Force Majeure Event or by our failure to comply with its obligations under the Contract in respect of the Goods we shall store the Goods until delivery takes place, and charge you for all related costs and expenses (including insurance).

For the purposes of these Terms and Conditions a Force Majeure Event shall means an event beyond our reasonable control of including but not limited to strikes, lock-outs or other industrial disputes (whether involving the workforce of the party or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors. We shall not be liable to you because of any delay or failure to perform its obligations under this Contract because of a Force Majeure Event. If the Force Majeure Event prevents us from installing the Goods we shall, without limiting our other rights or remedies, have the right to terminate this Contract immediately by giving written notice to you.

We are not responsible for the negative effects of climate, pollution, acts of God and long or semi-permanent installations. Because tents are temporary structures by nature, it is the customer's responsibility to protect their tents against the effects of weather, vandalism, falling debris and other environmental or foreign agents.

• Once goods leave the factory premises, we will not be responsible
• No Refund, No Claim, No Replacement and No Exchange offered
• If any Inspection or changes than it will be made in factory premises only
• All Orders & payments to be made in favour of “Kirti Creations” only
• Subject to Jodhpur, Rajasthan, India Jurisdiction.

It will be under Indian Law and area will be Jodhpur Rajasthan Jurisdiction only.
